    When this office prepares a Petition and Order for a couple under Act 145, the fee to be charged is $10.00.

    The receipt will be given at the time we prepare the documents.  Be sure to include, on the receipt, “For filing Petition, Order and Costs for Act 145.”

    The $10.00 is in addition to the $60.00 for the marriage license and must also be paid in cash.  If the Judge does not sign the Order, the $10.00 will not be returned.

    For your information, the costs cover the printing, indexing and other Probate related matters.

    ACT 145

    The couple must appear together with the parents of the one that is underage.  The girl must be pregnant and have a notarized letter from the doctor stating when the baby is due.  In a case where the baby is already born, a copy of the baby’s birth certificate is required.  The couple must also have state certified copies of their birth certificates and parents must have legal forms of identification.

    Fill out the application along with copies of all above to be attached.  Fill out two (2) Orders and one (1) Petition.  Have the couple sign the petition.  Charge the $10.00 for preparing the Orders and Petition.  Contact Probate and then escort the group to that department with the paperwork.

    After they come back from the Judge, collect the $60.00 in cash, and have everyone sign in the proper places on the Bond Page.  Issue the Marriage License.

    The application, Order, Petition, and all other papers are put in the Act 145 file after being indexed in the book.  The blank intent with the book and page number is placed with the other intents and marked Act 145 or 146.

    The difference between Act 145 and Act 146:
    Act 145, the girl is pregnant and underage.
    Act 146, the girl has already given birth and is underage.
